The terms of the lease agreement, in accordance with which the non-residential premises are transferred, provide for the receipt by one of the parties (the tenant) of an object for temporary use, which is officially registered as the property of the second party (the landlord).

Since an agreement of this kind is called preliminary, the document on the basis of which the actual transfer of non-residential premises for use to the second party takes place is called the act of transferring the premises (in this case, non-residential).

Such a document certifies that one of the parties (in the contract referred to as the lessor) transfers property to the other party (called the lessee), and the latter accepts this real estate for rent on the terms stipulated by the lease agreement.

The act of acceptance and transfer drawn up by the participants in the transaction must display individual signs of the leased area, which would individualize the object.

It is mandatory to indicate the following information about non-residential area:

  • conditional and cadastral numbering;
  • placement address;
  • technical condition;
  • size of the area;
  • availability of services provided at the facility (we are talking about the presence of water, electricity, heating, telephone, security system, Internet, etc.) in the premises.

If necessary, the parties may also attach a cadastral passport for the designated area to the act of acceptance and transfer of non-residential premises, etc.

An act as an integral part of a transaction with real estate objects

The terms of the lease agreement concluded between the parties, first of all, oblige each of them to draw up such a document as an act of acceptance and transfer of the premises, in order to confirm the transfer of property.

If the parties to the lease agreement in the future do not draw up an act of acceptance and transfer of real estate, then the main agreement, under the terms of which the non-residential premises are transferred for use, will only have the status of a preliminary document that does not entail the fact of using real estate.

This entails the occurrence of a certain number of consequences: payments determined by the parties as a payment for rent cannot be paid, the party does not bear responsibility related to the technical maintenance of the leased area, and more.

The same is true for the conditions that apply to the execution of a long-term lease agreement. Subject to the provisions of the current legislation, if the lease term is indicated in the terms of the lease agreement for more than one year, the document will need to be registered in the manner prescribed by the state.

The lease agreement, which has passed the registration procedure, must be accompanied by an act signed between the parties and confirming the transfer of property.
